Who can sell CBD products? Where is Delta 8 legal or illegal? Here’s quick guide to the CBD, Hemp & D8 laws in all 50 states, as of 2022 (Updated 9/13/22)
The 2018 Farm Bill generally made it legal to purchase and consume CBD and cannabinoid products derived from hemp in the United States, so long as they aren't advertised as medicines or included in foods or beverages. Though there are few exceptions! There are still regions in the United States where buying CBD is illegal, for instance, states like Idaho and Nebraska have not fully enacted the Farm Bill. Additionally, issues with "Full Spectrum" hemp products that may fall below can become complicated. 3% or more delta 9 THC. 3% when taking Total THC calculations into account. While these products are expressly prohibited in some states, they are legal in some. Finally, the popularity of Delta 8 THC has led to legislation against it being passed in many states. While in some states it falls under the 2018 farm bill's definition of "Legal Hemp," this is not the case.
Fortunately, this guide should help make things more understandable on a state-by-state basis. ** Readers should be aware that laws are constantly changing and should not take the information in this article as legal advice. They should consult with their own legal counsel familiar with state laws before producing, processing, buying, or selling.

WISCONSIN
There are many locations to find CBD products in Wisconsin because the state has a well-established medical CBD market dating back to 2014. Any hemp-derived CBD products that test under.3% thc are now legal to buy and consume in general since the state adopted the 2018 Farm Bill standards in 2018. Full Spectrum hemp products that might not meet a Total THC requirement in some areas, as well as Delta 8 products, have not been outlawed because the state's definition of THC was vague.
- Products must be under.3% D9 THC
- Full spectrum products are acceptable
- Delta-8 is not currently prohibited
- Hemp and CBD are both widely legal
